三亚市中小企业担保基金管理办法


第一条 为解决中小企业融资担保问题，支持中小企业改革和发展，特设立三亚市中小企业担保基金并制订本办法。
第二条 本办法所指中小企业信用担保，是指经政府及政府指定部门审核批准设立并依法登记注册的中小企业信用担保专门机构与债权人（包括银行等金融机构）约定，当被担保人不履行或不能履行主合同约定债务时，担保机构承担约定的责任或履行债务的行为。
本担保基金的管理机构为三亚市中小企业信用担保中心（以下简称担保中心），经三亚市人民政府批准后设立为事业法人，享有独立的经营权与民事权。
第三条 本办法所称的担保，遵循中华人民共和国《担保法》的规定，实行平等、自愿、公平、诚实、信用的原则，通过科学的风险管理机制，在合理分担风险的前提下，讲究经济效益，保障合同当事人各方的合法权益。
第四条 担保基金由各级政府投入、国内外机构、团体的资助以及专业担保机构投资等形成，其来源渠道有：
1、政府的投入；
2、以出让方式取得的土地使用权、其它经营性和非经营性国有不动产；
3、国内有关机构、组织提供的资助；
4、受保企业缴纳的风险保证金；
5、基金收益补充；
6、其它。
基金总额设定不少于1000万元人民币。
第五条 中小企业担保基金在适当时候可以吸收本地区有实力的优秀企业参加，也可以接收海内外社会各界的各种捐赠。
第六条 担保机构对单个企业提供的担保责任金额最高不得超过担保机构自身实收资本的10%；担保机构担保责任余额不得超过担保机构自身实收资本的5倍。
第七条 为加强对中小企业信用担保行为的监督管理，防范担保风险，市政府设立由市财政局、市发展和改革局、市科技工业发展委员会、人民银行、工商行政管理部门及合作银行等部门组成的中小企业信用担保监管委员会（以下简称监管会），作为三亚市中小企业信用担保中心的监督管理机构。
第八条 监管会履行以下职责：
1、决定担保中心的年度经营、投资、财务预决算、利润分配、弥补亏损等方案；
2、决定担保中心的机构设置；
3、审批担保中心章程；
4、提请任命并聘任担保中心主要负责人；
5、审批担保运作的基本管理制度；
6、审批担保中心变更形式和解散方案；
7、审议和决定担保中心其它重大事项。
第九条 担保中心为中小企业担保基金日常管理机构。其职责为：
1、执行监管会批准的年度工作计划，组织实施监管会决议；
2、对监管会负责，于每年一季度报告上年度工作执行情况及本年度工作计划；
3、负责中小企业担保基金日常管理和运作；
4、提请监管会审议、核销坏账；
5、提请监管会审议增资或补充资本方案；
6、负责中小企业担保基金的财务分类核算。
第十条 中小企业担保基金的使用原则是：优先支持符合国家产业政策和三亚市产业发展方向及环境保护标准的项目；节约能源、降低物耗、提高产品质量、发展市场短缺的名优新产品项目；扩大出口创汇、引进技术消化吸收及创新替代进口的项目；市场和经济效益前景好的，企业具有良好信誉并有较强还贷能力的项目；吸纳劳动力多，增加就业机会和税收收入的项目等。
第十一条 需要提供融资担保的国有中小企业由市国资主管部门推荐，其他企业可自行申请，担保中心按照项目评估体系及有关协议，独立进行评估或与社会中介机构联合评估，报监管会批准后，由担保中心统一出具相关法律文件。
第十二条 担保中心必须要求受保企业提供反担保。反担保包括提供反担保人和抵押（质押）两种方式。担保中心应与受保企业签定反担保合同。反担保合同须经公证机关公证。
第十三条 中小企业担保基金，要在确保各方利益的前提下，遵循市场法则运作，定向设立，分类定向使用，统一管理，分别核算，安全运营，确保增值，透明监督。
第十四条 中小企业担保基金，经监管会批准后，由担保中心统一存入特别开立的账户，进行专户管理。担保基金严禁向企业或项目直接投资。
第十五条 每发生一笔担保业务，从担保基金中提取该笔担保额5%的资金作为风险准备金，用于代偿和核销坏账。该笔担保项目按时履约解除担保责任时，将预提的风险准备金的80%返还，并入担保基金总额。当风险准备金提取到一定数额时，停止或相应降低提取比例。
第十六条 担保项目发生代偿时，由贷款银行通知担保中心，经审核无误后从风险准备金中支付代偿，不足部分从担保基金本金中同比例支付。项目代偿后，由项目推荐人负责协助担保中心处置反担保抵押或质押物，收回的资金用于弥补担保基金。
第十七条 确认坏账的条件
l、被保证人破产或死亡，其破产财产处置收入或遗产收入清偿后仍无法收回；
2、经执行法律程序后仍无法收回。
3、因被保证人逾期末履行偿债义务超过三年仍然不能收回的。
第十八条 坏账由监管会确认、审核同意后核销，冲减风险准备金。
第十九条 项目担保费在交纳营业税后的净收益及担保基金的利息和运作收益，在扣除运营管理成本、费用后，统一并入担保基金总额。
第二十条 担保基金按年度核算，由担保中心于次年一季度向监管会报告担保基金财务情况，并提出盈余分配或亏损处置方案，由监管会批准执行。
第二十一条 本办法如与国家的法律、法规不一致时，应做相应修改和调整。
第二十二条 本办法在担保业务实际运作过程中，根据需要和情况的变更，作出修改。
第二十三条 本办法由市人民政府负责解释。
第二十四条 本办法自2006年9月19日 起实施。
